JUSTICE PRAVEER BHATNAGAR Order 10/09/2026 1. These instant second bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.68/2025 registered at Police Station Raja Khera, District Dholpur for the offence(s) under Sections 189(2), 115(2), 126(2), 351(2) and 109(1) of BNS. [2026:RJ-JP:36627] (2 of 3) [CRLMB-9247/2026] 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the name of the petitioners namely: Vijay Pal and Ramnaresh are not mentioned in the FIR lodged by PW-1 Bhuri Singh. It is also contended that PW-1 in his examination-in- chief before the Trial Court deposed that the other co-accused assaulted the deceased with the aid of lathi and rods. There is no specific allegation qua the petitioners that they assaulted the deceased with the arms. It is also contended that similarly, the other eye witnesses namely PW-2 Madho Singh and PW-3 Ramavtar in their deposition also stated that the other co-accused assaulted the deceased, though they have named the accused- petitioners in their statement, however, no specific allegations regarding assault by them are made in their statements. It is also contended that the site plan Exhibit- P3 was prepared before the complainant PW-1 Bhuri Singh and aforesaid two eye witnesses and in the site plan also the names of the present petitioners were not disclosed by the eye witnesses. The accused-petitioners are in custody since long and further trial of the case may take considerable time, therefore, these second bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed these second bail applications and contended that the eye witnesses namely: PW-2 Madho Singh and PW-3 Ramavtar, in their deposition have clearly stated that the petitioners were also present with the other co- accused who assaulted the deceased. It is also contended that the complainant- Bhuri Singh was not knowing the petitioners and [2026:RJ-JP:36627] (3 of 3) [CRLMB-9247/2026] immediately the names of the petitioners were disclosed by the eye witnesses, in their police statements to the Investigating Officer and in the Court statements they have corroborated the prosecution story, therefore, considering the aforesaid facts, the second bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioners and more particularly the fact that the names of the petitioners were not mentioned in the FIR as well as in the site plan in which the eye witnesses are also the witnesses. In the Court statements also the specific allegation of causing assault with the aid of sticks and rods are against the other co-accused, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these second bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely: 1. Vijaypal S/o Shri Vishambhar Singh and 2. Ramnaresh @ Naresh @ Neta S/o Shri Lokman, in connection with FIR No.68/2025 registered at Police Station Raja Khera, District Dholpur, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
