JUSTICE PRAVEER BHATNAGAR Order 10/09/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 130/2026 registered at Police Station Mundawar, District Khaithal-Tijara for the offences under Sections 112(2)(b), 189(2), 109(1) of the BNS, 2023 and 5, 7 Arms Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. The first bail application of the petitioner was dismissed as withdrawn with liberty to file bail application afresh after filing of the charge- sheet. He further submits that thereafter charge-sheet has been filed, in the charge-sheet, the specific allegation of using the fire arms is against the other co-accused Ashish. In the statement rendered under Section 180 of the BNSS, eye-witnesses Sandeep, [2026:RJ-JP:36636] (2 of 2) [CRLMB-10994/2026] Jaideep and Sachin have stated that Ashish used the fire arms though the name of the petitioner was mentioned in the FIR as the main culprit. It is also contended that the other similarly placed co-accused have already enlarged on bail. Therefore, considering the aforesaid facts, the second bail application of the petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the second bail application. 4. Heard and perused the material available on record. 5. Considering the fact that the specific allegation of using the fire arm towards complainant is against the other co-accused Ashish Jat and the fact that the petitioner is in custody since long and further trial of the case may take considerable time, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, this second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Ajay @ Sonu S/o Suresh, in connection with FIR No. 130/2026 registered at Police Station Mundawar, District Khaithal-Tijara, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
