JUSTICE LALITHA KANNEGANTI - 4 - HC-KAR NC: 2026:KHC:19867 WP No. 14643 of 2023 ORAL ORDER The present writ petition is filed seeking the following prayers. "i. ISSUE a Writ or Order or Direction declaring the act of the Respondents demolishing the compound wall put up by the Petitioner on his property bearing Sy. No. 40/1 measuring 26 guntas Devara Chickannahalli village, is illegal and without the authority of law; ii. ISSUE a Writ or Order or Direction directing the BDA, Respondent No.6 to pay compensation of Rupees 10 lakhs to the Petitioner for the damages caused by illegal demolition of the Compound Wall; iii. ISSUE a Writ of Mandamus Directing the Commissioner of Police and Deputy Commissioner of Police Respondent Nos. 3 & 4 to give protection to the Petitioner against Respondent BDA and its officials from interfering with the Petitioner's peaceful possession and enjoyment of the property measuring 26 guntas in Sy. No. 40/1 of Devara Chickannahalli Village; iv. Issue a writ or order or direction directing the Respondent No. 2 State Government to - 5 - HC-KAR NC: 2026:KHC:19867 WP No. 14643 of 2023 take disciplinary action against the BDA officials for taking law into their own hands in demolishing the Compound wall of the Petitioner in Sy. No. 40/1 of Devara Chickannahalli Village measuring 26 guntas and for interfering with possession without the authority of law; and v. Pass such other Order/s as this Hon'ble Court deems fit under the facts and circumstances of the case in the interest of Justice and Equity." 2. Learned counsel appearing for the petitioner submits that the issue with regard to the land acquisition and the dispute with regard to the property has attained finality in the light of the order passed by the Hon'ble Apex Court in SLP Diary No(s).46466/2024 dated 11.11.2024. It is further submitted that in the light of the said order, the BDA cannot interfere with the petitioner’s possession of the property. 3. Learned counsel appearing for the respondent BDA does not dispute the same. It is further submitted that the other reliefs sought by the petitioner before this Court with regard to the compensation, police protection and also taking - 6 - HC-KAR NC: 2026:KHC:19867 WP No. 14643 of 2023 action against the BDA officials, do not survive for consideration. 4. Having heard the learned counsel on either side, perused the material on record. 5. The petitioner is seeking compensation for the unauthorized demolition of the compound wall by the BDA, as well as police protection to prevent interference by the BDA with his peaceful possession of the property. In light of the submission made by the learned counsel for the respondent BDA that they are not interfering, as the litigation has attained finality, no orders are required to be passed on those reliefs. As regards the other relief, the petitioner is at liberty to avail appropriate remedy before the Civil Court. 6. In view of the above, this Court is passing the following : ORDER i. Accordingly, the writ petition is disposed of, directing the respondent BDA not to interfere with the petitioner's peaceful possession and enjoyment of the property. - 7 - HC-KAR NC: 2026:KHC:19867 WP No. 14643 of 2023 ii.
