Issue a writ of Mandamus, or any other appropriate writ, order or direction to the respondent no. I to consider and decide the petitioner's representation dated 20.06.2026 by passing a reasoned order within a time period as may be fixed by this Hon'ble Court. B. Issue a writ of Mandamus, or any other appropriate writ, order or direction thereby directing the respondent no. 1 to conduct an appropriate inquiry into the allegations made by the petitioner regarding the coercive and misleading practices adopted during renewal of the petitioner's health insurance policy by the authorised representative of the respondent no. 2 and to take such regulatory action as may be warranted in accordance with law. C. Issue a writ of Mandamus, or any other appropriate writ, order or direction thereby directing the respondent no. I to issue appropriate regulatory directions, advisories or guidelines, in accordance with law, to ensure that insurers, intermediaries and their authorised representatives This is a digitally signed order. I.” 2. Issue notice. The learned counsel accepts notice on behalf of respondents. 3. Briefly stated the facts of the present case, as mentioned in the writ petition, are that the petitioner’s health insurance policy with respondent No. 2, Niva Bupa Health Insurance, was due for renewal on 30.03.2026. The petitioner had paid ₹43,675/- towards renewal premium on 03.02.2026. Thereafter, respondent No. 2 had allegedly represented that renewal was conditional upon purchasing a Personal Accident Policy, purportedly as mandated by IRDAI, pursuant to which the petitioner paid ₹3,693/- for the additional policy. The policy was subsequently cancelled, but only a pro-rata refund was made. Despite complaints to respondent No. 2 and IRDAI, including a representation dated 20.06.2026, no effective action was taken. The petitioner alleges coercive cross-selling and unfair practices warranting regulatory intervention by IRDAI. 4. Aggrieved by the continuing proceedings and failure to decide its pending representation, the petitioner has filed the present writ petition. 5. After hearing learned counsel appearing on behalf of the petitioner and in view of the issue involved in the instant petition, this Court finds it appropriate to direct that the present petition filed before this Court be treated as a representation on behalf of the petitioner, in addition to the representation already filed, and the respondents are directed to decide the same, within a period of eight weeks from date, under intimation to the petitioner herein.
