This bail application has been filed on behalf of Prabhu Malhar, Mithlesh Malhar and Arun Malhar who are in custody since 2209.2025 in connection with Nawalshahi P.S. Case No. 87 corresponding to G.R. Case No. 738 of 2025 of 2025 for the offence registered under Sections 317(2), 317(5) and 3(5) of the BNS, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Koderma, is pressed into motion. Matter involves theft of two tractor batteries and there is no direct eye witness to the commission of offence. The allegation is that the stolen batteries were recovered from these petitioners. It is also submitted that these petitioners have no criminal antecedent and he has been falsely implicated in this case. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioners are directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) each with two sureties of the like amount each to the satisfaction of the Court below.
