Learned counsel for the petitioner submits that the learned Judicial Magistrate, 9th Court at Alipore, South 24 Parganas granted an interim maintenance in the sum of Rs.1 lakh to the petitioner vide order dated 16th June, 2025. This order was challenged by the opposite party/husband before the learned Sessions Judge, Alipore, South 24 Parganas in Criminal Motion No.251 of 2025. Learned counsel submits that the learned Sessions Judge vide order dated 8th August, 2025 reduced the amount of interim maintenance to Rs.10,000/-. Vide order dated 8th August, 2025 without affording an opportunity of being heard to the petitioner. 2. Admittedly, the matter is still pending before the learned Sessions Judge. Let the matter be argued before the learned Sessions Judge. Learned Sessions Judge is directed to dispose of the petition expeditiously after affording both the parties an opportunity of being heard. 3. Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to raise all the contentions before the learned Sessions Judge. 2 4. Liberty granted. 5. Petition is disposed of. 6. However, it is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression on the merits of the case. 7.
