Heard both the sides. This bail application has been filed on behalf of Manoj Singh who is in custody since 10.03.2025 in connection with S.T. Case No. 351 of 2025 arising out of Giridih (M) P.S. Case No. 66 of 2025 (GR No. 953 of 2025) for the offence registered under Sections 103(1) and 3(5) of the BNS, charged framed under Section 103(1) BNS with alternative charge under Section 108 of BNS pending in the Court of Addl. Sessions Judge-VII, Giridih, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that initially the case was lodged under Sections 103(1) and 3(5) of BNS and the charge-sheet was submitted under Section 108 of BNS, 2023. It is also submitted that there was no abetment on the part of the petitioner in the suicidal death of his wife. It is alleged that he was having adulterous relationship with his sister-in-law, however that is no longer an offence. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
