THE HONOURABLE DR JUSTICE Y. LAKSHMANA RAO CRIMINAL PETITION NO: 254/2026 ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to quash the proceedings against the Petitioner/Accused No.2 in C.C.No.134 of 2023 on the file of the learned III Additional Judicial Magistrate of First Class, Chittoor, Chittoor District, registered for the alleged offences punishable under Section 67B of the Information Technology Act, 2000 (for brevity, ‘the I.T Act’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The learned counsel for the petitioner submits that the presence of the petitioner may be dispensed with before the learned Trial Court. The learned counsel for the petitioner further submits that some unknown persons tagged the video and posted the same on social media in the name of the petitioner. The petitioner has not committed any offence. 4. As seen from the record, the above said contention is a matter for trial. The charge sheet has already been filed. The accusation is well founded. Therefore, the proceedings on the file of the learned Magistrate cannot be quashed. The learned counsel for the petitioner submits that the petitioner has been working as a Software Engineer in Bangalore. 3 Dr. YLR, J Crl.P.No.254 of 2026 Dated 19.01.2026
5. Considering the facts and circumstances of the case, the Criminal Petition is disposed of directing the learned III Additional Judicial Magistrate of First Class, Chittoor, Chittoor District not to insist upon the presence of the Petitioner/Accused No.2 on every adjournment.
However, the learned III Additional Judicial Magistrate of First Class, Chittoor, Chittoor District, is at liberty to secure the presence of the Petitioner/Accused No.2 on the crucial dates where his presence is required for the conduct of the trial of the case or otherwise. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y. LAKSHMANA RAO, J Date: 19.01.2026 PRA
