The present petition has been filed seeking stay of the operation, implementation and execution of the externment order dated 14.07.2026, passed by the Additional Deputy Commissioner of Police-I, South West District, New Delhi, under Section 47 of the Delhi Police Act, 1978, till the first effective hearing of the statutory appeal preferred by the Petitioner.

Learned counsel for the Petitioner submits that the Petitioner has already preferred a statutory appeal under Section 51 of the Delhi Police Act, 1978, against the externment order. The said appeal is listed before the Hon’ble Lieutenant Governor of Delhi on 26.08.2026. It is submitted that, This is a digitally signed order. until the appeal is taken up for consideration, the Petitioner ought to be granted interim protection.

Learned counsel further submits that the Petitioner is a daily wage labourer and earns his livelihood by undertaking labour work in Delhi. It is submitted that the Petitioner does not have any regular source of income outside Delhi and his continued exclusion from Delhi would cause severe financial hardship to him and his family.

Learned counsel for the Respondents opposes the petition and submits that no stay of the externment order can be granted by this Court in the present proceedings. He further submits that learned counsel for the Petitioner has admitted during the course of hearing that the Petitioner has already left Delhi in compliance with the externment order. He further submits that the limited relief sought in the present petition no longer survives and the petition has become infructuous.
6. This Court has heard learned counsel for the parties and has considered the record.
7. The present petition was instituted for the limited purpose of seeking interim protection against the externment order till the first effective hearing of the statutory appeal. Learned counsel for the Petitioner admits that the Petitioner has already left Delhi in compliance with the externment order.
8. In view of the said admitted position and the limited nature of the relief sought, no further orders are called for in the present proceedings. The petition has, therefore, become infructuous.

The submission that the Petitioner is a daily wage labourer and is required to remain in Delhi for earning his livelihood does not alter the admitted position regarding compliance with the externment order. circumstance, by itself, does not carry sufficient weight to justify the grant of relief in the present petition.
10. It is clarified that this Court has not expressed any opinion on the merits of either the externment order or the statutory appeal preferred by the Petitioner. The statutory appeal shall be considered by the Hon’ble Lieutenant Governor of Delhi on its own merits and in accordance with law.
11. Accordingly, the present petition is dismissed as infructuous. Pending application(s), if any, also stand disposed of.
