It is contended that plaintiffs-respondents instituted two suits, one being Original Suit No. 544 of 2016 and the other Original Suit no. 164 of 2016 for cancellation of sale-deed against defendants-petitioners. It is contended that subsequent suit be stayed. 3. This Court, after hearing learned counsel for petitioner and perusing the material on record, finds that defendants-petitioners have remedy of filing an application under Section 10 CPC for staying the subsequent suit which has been filed against them as the subject-matter in both suits is one and the same and parties are also same. In case, such application is moved by petitioner, the court concerned shall decide the same, expeditiously. 4. The writ petition stands disposed of. October 9, 2026 (V. S.
