Learned counsel for the petitioner submits that the petitioner was initially appointed as Lecturer (Geography) on 12.10.1973 and was subsequently promoted to the post of Principal on 30.08.1990. The petitioner retired from the post of Principal on 31.08.2010. It is further submitted that certain similarly situated employees had earlier filed representations before this Court which was registered as WPS No. 4421/2008, wherein a grievance was raised regarding reduction of their pay scale from Rs. 2375-4125 to Rs. 2000-3500. This Court vide order dated 08.03.2013 allowed the said writ petition and quashed the impugned order reducing the pay scale of the petitioners therein. Consequently, they were held entitled to the pay scale of Rs. 2375-4125 from the date of their promotion. 3. It is further submitted that the present petitioner also preferred WPS No. 1944/2015. This Court, while relying upon the judgment rendered in WPS No. 4421/2008, permitted the petitioner to submit a representation before the competent authority seeking similar relief on the ground of parity. Pursuant thereto, the petitioner submitted a representation, which was considered favourably and respondent No. 1, vide communication dated 27.11.2017 directed the District Education Officer, District Balrampur, and the Block Education Officer, District Balrampur to grant the pay scale of Rs. 2375-4125 to the petitioner from the date of his promotion and to re-fix his pay scale and pension accordingly. However, despite lapse of considerable time, the said 3 directions have not been complied with compelling the petitioner to file the present writ petition. 4. Learned counsel for the respondents submits that certain documents were sought from the petitioner by the District Education Officer and upon submission of the requisite documents by the petitioner, his case would be duly considered by the competent authority. 5. Heard learned counsel for the parties and perused the record. 6. There is no dispute regarding the fact that the petitioner is entitled to the pay scale of Rs. 2375-4125 from the date of his promotion to the post of Principal, i.e., 30.08.1990. Similarly situated persons had earlier filed writ petitions which were allowed by this Court. In line with the said judgments, the petitioner’s representation was also allowed and directions were issued by the State Government to the concerned authorities for re-fixation of his pay scale and pension. It appears that despite the passage of several years, the said exercise has not been carried out by the respondents. Accordingly, the respondents are directed to comply with the communication dated 27.11.2017 filed as Annexure P/12, and to re-fix the pay scale and pension of the petitioner in terms of the said communication within a period of 90 days from the date of receipt of a copy of this order and to pay the arrears, if any, within the said period. 7.
