It has been averred in the application that even though certified copy of the impugned judgment and decree, dated 05.08.2025 was applied on 05.08.2025 and delivered on 13.11.2025, however the same was received in the office of Superintending Engineer, 12th Circle, HPPWD Nahan on 01.12.2025. Thereafter, legal opinion was sought and the matter was examined at various levels for filing the appeal and in this process, considerable delay has occurred, which is neither intentional nor deliberate, but the same is due to unavoidable circumstances, which were beyond the control of the applicants. Learned counsel for the respondents have no objection in case the instant application is allowed. Consequently, in view of the reasons stated in the application, more particularly in paras 2 to 4 thereof, which is duly supported by an affidavit, coupled with submissions made by the learned Additional Advocate General for the applicants, delay in filing the main appeal is condoned. Appeal be registered. Application stands disposed of.
