By the way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), the petitioner is seeking quashing of e-FIR No. 80129460/2024, registered at Police Station Dwarka North, District Dwarka, Delhi for offences punishable under Sections 305/306/317/(2)/61(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. The petitioner and Mr. Shubham Aggarwal, who is the complainant in the present FIR as well as the authorised representative of the company concerned, are present in Court and have been duly identified by their respective counsel and the Investigating Officer (IO). 5. Respondent No.2 has handed over his authorisation letter in Court today. Let the same be taken on record. 6. Briefly stated, on 14.11.2024, a masked woman allegedly entered the office of M/s Asclepius Wellness Private Limited, disabled the CCTV cameras and removed ₹1,62,846/- from the cash counter. On the complaint of respondent No.2, the present FIR was registered. During investigation, the involvement of the petitioners surfaced and the charge-sheet was filed under Sections 305/306/317(2)/61(2)/3(5) BNS. 7. During the pendency of the proceedings, the loss caused to the complainant company was made good and the parties amicably settled the matter vide Settlement Deed dated 16.07.2026. Respondent No.2 has no objection to the quashing of the FIR and the proceedings emanating therefrom. 8. On a query made by this Court, respondent no. 2 who has been duly identified by the IO, has categorically stated that he has entered into the concerned compromise, vide Settlement Agreement dated 16.07.2026, out of his own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. This is a digitally signed order. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment to the quashing of FIR in question. 10. Accordingly, e-FIR No. 80129460/2024, registered at Police Station Dwarka North, District Dwarka, Delhi for the offences punishable under Sections 305/306/317/(2)/61(2)/3(5) of the BNS along with all consequential proceedings emanating therefrom, is hereby quashed. 11. The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of. 12. A copy of this order be sent to the concerned Trial Court for necessary action and compliance. 13.
