Heard learned counsel for the parties. 2. The instant writ application has been preferred by the petitioner praying therein for the following reliefs: i) a writ in the nature of Certiorari and/or any other appropriate writ be issued for the quashing the order dated 13.1.09 passed by the respondent no 3 in case no 9/2008 as find contained in memo no 28 dated 13.1.09 whereby and whereunder he was pleased to cancel the selection of the petitioner to the post of Sevika (Annexure-3); and ii) a writ in the nature of mandamus and/or any other appropriate writ be issued commanding the respondent authorities to allow the petitioner to continue to her post; 3. A counter affidavit has been filed on behalf of the respondent Nos. 3, 5 and 6 and after going through the same it appears that the petitioner has filed the writ petition for quashing of order dated 13.01.2009 passed by Deputy Commissioner in Case No. 09/08 contained in Memo No. 28 dated 13.01.2009 whereby and whereunder the Deputy Commissioner cancelled the selection of the petitioner from the post of Sevika. It further 2026:JHHC:8737 2 appears that there had been Aam Sabha (General meeting) on 31.01.2007 of villagers under the chairmanship of Executive officer-cum-Deputy Director, National Savings, Dumka in which seven candidates including this petitioner had filed petition for selection to the post of Sevika and 5 candidates had filed petition for the post of Sahayika for the Anganbari Centre Khojwa of Saraiyahat Block of Dumka District. In this meeting, the decision for selection could not be finalized due to disorder in the meeting and accordingly Executive Officer -cum-Deputy Director, National Savings Dumka submitted his report. 4. It further appears that again, there had been Block Level Committee Meeting on 09.03.2007 in presence of Senior Officer Director, D.R.D.A., Dumka for finalization of selection of the post of Sevika/Sahayika of Anganbari Centre Khajwa of Saraiyahat Block of Dumka District. In this Block Level Committee held on 09.03.2007, this petitioner-Anita Jha had been selected for the post of Sevika for Anganbari Centre at Khojwa. 5. It further appears that against the order of selection of this petitioner-Anita Jha, made in the post of Sevika, Kumari Supriya had filed W.P. (S) No. 4970/2007 in this Court in which order was passed on 23.06.2008. Thereafter, Smt./Kumari Supriya W/o Rajesh Ranjan Jha of village-Khojwa filed a petition before the Deputy Commissioner, Dumka along with the copy of order dated 23.06.2008 passed by this Court in W.P. (S) No. 4970/2007 and it was registered as Case No. 09/2008 Kumari Supriya vs. Anita Jha before the Deputy Commissioner, Dumka 2026:JHHC:8737 3 and in this case, report was submitted by the District Programme Officer, Dumka vide letter No. 16 dated 09.01.2009. 6. Finally, after hearing all parties and perusing the papers filed in the case, the Deputy Commissioner, Dumka passed an order on 13.01.2009 in Case No. 09/2008 whereunder the selection of Anita Jha on the post of Sevika for Anganbari Centre Khojwa has been cancelled as proper guidelines were not adopted during the time of her selection as Sevika. This order dated 13.01.2009 passed by the Deputy Commissioner, Dumka in Case No. 09/2008 was communicated by the District Programme Officer, Dumka vide Memo no. 28 dated 13.01.2009. 7. Having regard to the above, this Court is not inclined to interfere with the impugned order; as such, no relief can be granted to this petitioner. 8.
