The petitioner gave a representation to the respondent -Tahsildar, Madduru Taluk, seeking to enter the name of the petitioner's father, pursuant to the registered sale deed dated 01.03.1967 by virtue of which the petitioner's father is said to have purchased 6 guntas and 2 guntas separately in Survey No.106/4 of Ajjahalli - 3 - HC-KAR NC: 2026:KHC:13173 WP No. 38883 of 2025 Village, Kasaba Hobli, Madduru Taluk. The respondent - Tahsildar issued the impugned endorsement at Annexure- C dated 11.09.2020 stating that the name of the vendor in the sale deed is not reflected in the RTC and therefore the request made by the petitioner was rejected. The Assistant Commissioner, in appeal proceedings also stated the same and rejected the appeal. The Deputy Commissioner, who is the Revisional Authority under Section 136(3) of the Karnataka Land Revenue Act has directed the petitioner to approach a competent civil court to get a declaration of title. 3. Normally, this Court would have directed the Tahsildar to issue notice to the present Kathedar to find out whether the Kathedar has any objection to the application or representation given by the petitioner. However, in the present case the claim of the petitioner arises from a sale deed of the year 1967 and therefore as rightly directed by the Deputy Commissioner, the petitioner will have to approach a competent civil court to - 4 - HC-KAR NC: 2026:KHC:13173 WP No. 38883 of 2025 get a declaration of title. As and when declaration is given in favour of the petitioner, the petitioner will have a right to seek his name to be entered in the revenue records.
