2026:JHHC:4148 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 12135 of 2025 ------ Parmeshwar Mahto, S/o Shivshankar Mahto @ Late Samar Mahto, R/o Village-Faujdarbank, PO-Noni, PS-Chitra, Dist.-Deoghar, Jharkhand .... .... …. Petitioner Versus 1. The State of Jharkhand 2. Subhadra Kumari Devi, D/o Ajit Kumar Mahto, R/o Village-Dighi, PO & PS-Chitra, District-Deoghar .... .... .... Opposite Parties CORAM: HON'BLE MR. JUSTICE GAUTAM KUMAR CHOUDHARY For the Petitioner : Mr. Pran Pranay, Advocate Ms. Kehkashan Afsheen, Advocate For the State : Mr. Vijoy Kumar Sinha, APP ------ Order No.02 / Dated : 13.02.2026. Heard both the sides. This bail application has been filed on behalf of Parmeshwar Mahto who is in custody since 10.09.2025 in connection with P.C.R. Case No. 144 of 2019 for the offence registered under Sections 498-A, 323 and 34 of the IPC pending in the Court of learned Judicial Magistrate 1st Class, Madhupur, is pressed into motion. It is submitted by learned counsel for the petitioner that the petitioner was earlier granted anticipatory bail by the Co-ordinate Bench of this Court in A.B.A. No. 3886 of 2020, subject to the condition of furnishing an undertaking that he will keep and maintain his wife with full honor and dignity as his lawful wife and on paying Rs.2000/- to her as litigation expense. Soon after the prosecutrix was taken by the petitioner to the matrimonial-home, she left and filed petition for cancellation of bail, following which the bail of the petitioner has been cancelled and he has been taken to judicial custody. It is contended that his bail application was allowed on merit and he is still ready and willing to keep this wife. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
