WP (C) No. 1769/2026 Page 1 of 2 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Case No. : WP (C) No. 1769/2026 CM No. 3905/2026 Pooja Devi and another ….. Appellant/Petitioner(s) Through: Mr. Sunil Kumar, Advocate Vs UT of J&K and others .…. Respondent(s) Through: Mr. Anishwar Chatterji Koul, GA for R-1 to 3 Coram: HON’BLE THE CHIEF JUSTICE (ACTING) ORDER 06.06.2026 This is a petition, filed by the petitioners, seeking a direction to the official respondents to provide them adequate security cover and protection to their life and liberty. It is submitted that the petitioners are major and competent to take decisions regarding their own lives and have entered into a matrimonial wedlock on 07.05.2026 as per the Hindu Rites and Customs. It is their grievance that though the marriage has been solemnized by the petitioners out of their free will and volition, yet respondent Nos. 4 to 7 who are close relatives of petitioner No.1 are not happy and are creating unnecessary interference. They submit that they apprehend harm to their lives and liberty by the aforesaid respondents. Having heard learned counsel for the petitioners and the petitioners appearing in person, this Court is prima facie convinced that the petitioners before the Court are major and have apparently solemnized their marriage as per their free will and volition in accordance with the Hindu Rites and Customs. The Secondary School Examination Grade Card issued by the Jammu and Kashmir State Board of School Education appended with the petition clearly indicates that the petitioner No.1 having born on 03.09.2001 was 24 years old at the time of solemnization of her marriage with petitioner No.2. Sr. No. 85 WP (C) No. 1769/2026 Page 2 of 2 In this view of the matter, this petition is disposed of with a direction to respondent Nos. 1 to 3 to ensure that no harm is done to the life and liberty of the petitioners by respondent Nos. 4 to 7 or other relatives. Should the petitioners apprehend any threat from respondent Nos. 4 to 7 or other relatives, they shall be free to approach the respondent No.3 for seeking protection. In such situation, respondent No. 3 shall be duty bound to extend protection to their life and liberty. It is made clear that no opinion has been expressed with regard to the validity of their marriage. The writ petition is, accordingly, disposed of.
