JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed seeking bail under Section 483 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The offence alleged against the petitioner is under Section 8(c) and 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 ('NDPS Act') and Section 25-(1B)(b) of Arms Act, 1959. 2. The prosecution alleges that 11.47 grams of MDMA is recovered from the petitioner. It is also alleged that the petitioner was having a sickle at the time of raid. 3. The seized sample was sent for the forensic examination and it is found that the seized material is methamphetamine. As per the provisions of the NDPS Act and the notification dated 19.10.2001, 50 grams would be the commercial quantity. - 3 - HC-KAR NC: 2026:KHC:20186 CRL.P No. 14657 of 2025 4. For the aforementioned quantity, the punishment would be 10 years rigorous imprisonment. The materials recovered from the petitioner prima facie indicate that reasonable grounds are not made out to believe that the accused is not guilty of such offence. 5. It is submitted that one more case is pending in Crime No.278/2025 against the petitioner for the offence punishable under Section 118(2), 126(2) and 352 of Bharatiya Nyaya Sanhita, 2023 (BNS). 6. Under these circumstances, the Court is of the view that, no case is made out to grant the bail as prima- facie it appears that all the provisions of the NDPS Act, 1985 are complied. 7.
