3/28.04.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the Respondents. 2. Petitioner has rushed to this Court challenging the notice bearing No.1523(R) dated 19.11.2025 which has been issued by the Circle Officer, Godda. 3. It is the grievance of the petitioner that no notice could be issued to the petitioner as the petitioner is the raiyat of the land in question. As per him, since he has not encroached any portion of the

land, no eviction proceeding can be initiated. 4. After hearing the parties, I find that only the petitioner has been noticed to appear before the Circle Officer.
The Circle Officer has arrived at prima facie conclusion that the petitioner has encroached the land in mouza Pandubathan Plot No.200 within Khata No.74. Since the petitioner has only been noticed, I am not inclined to entertain this writ petitioner. 5. The petitioner should approach the authority concerned by producing necessary documents in support of his title over the property in question. 6. It is made clear that without initiating a proper proceeding under the Jharkhand Land Encroachment Act and for any other enactment, the petitioner cannot be forced to be evicted from his property. 7. With the aforesaid observation, this writ petitioner is disposed of. (ANANDA SEN, J.) 28.04.2026 R.Kumar Uploaded on 11.05.2026
