2026:HHC:27292 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA. CMP(M) No. 937 of 2026 and LPA No. 395 of 2026 Date of decision: 07.07.2026 Jyoti …Appellant Versus State of H. P. & Ors. …Respondents Coram The Hon’ble Mr. Justice G. S. Sandhawalia, Chief Justice. The Hon’ble Mr. Justice Bipin C. Negi, Judge. Whether approved for reporting? For the Appellant: Mr. R. L. Chaudhary, Advocate. For the Respondents: Mr. Gobind Korla, Additional Advocate General. G. S. Sandhawalia , Chief Justice (Oral) CMP(M) No. 937 of 2026 Keeping in view the averments made in the application, which is duly supported by the affidavit of the applicant, the nominal delay of 15 days is in filing the appeal condoned. 2. Application stands disposed of. LPA No. 395 of 2026 3. Learned counsel for the appellant submits he does not want to press the present appeal as in pursuance to the order passed on 09.12.2025 in CWP No. 15563 of 2024, titled as Jyoti vs. State of H.P. & Ors., respondents had issued fresh advertisement and selected respondent No. 3-Smt. Chandresh Kumari. It is the argument of the learned counsel for the appellant that the appellant was not even called for the interview. 2 2026:HHC:27292 5. In such circumstances, we are of the considered opinion that a fresh cause of action arises and, therefore, the present appeal has become infructuous. 6. Accordingly, the present appeal is disposed of as not pressed. However, it is open to the appellant to raise challenge to the appointment of respondent No. 3-Smt. Chandresh Kumari in accordance with law. 7. Pending application(s), if any, also stands disposed of. (G. S. Sandhawalia) Chief Justice (Bipin C. Negi) 7th July, 2026 Judge (sanjeev)
