[2026:RJ-JP:36151] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 11892/2026 CNR: RJHC020715292026 | URN: CRLMB / 21896U / 2026 Dinesh Kumar S/o Chetram, R/o Opposite Sitaram Dairy, Balita Road, Bapu Colony, Kunhadi, Police Station Kunhadi, District Kota, Rajasthan. (At Present Confined In District Jail, Baran). ----Petitioner Versus State Of Rajasthan, Through Special Pp ----Respondent For Petitioner(s) : Ms. Poonam Mishra Dr. Remdeo Arya For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 08/09/2026 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.312/2024 registered at Police Station Kunhari, District Kota City for offences under Section 109(1) of BNS, 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner contends that the petitioner has falsely been implicated in this case. The allegation levelled against the present petitioner is that he caused the death of his mother Prakash Bai. He submits that there is no incriminating evidence available on record against the present petitioner. Petitioner is behind the bars since 10.09.2024 without any criminal past. The investigation/trial of the case will take [2026:RJ-JP:36151] (2 of 2) [CRLMB-11892/2026] considerable time, therefore, no fruitful purpose would be served by keeping the petitioner, consequently, the bail application deserves to be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application and specifically states that the petitioner has been charged with the murder of her mother. The matter is presently listed for final arguments and there is ample incriminating evidence on record adduced by the prosecution. Therefore, the petitioner is not entitled to the grant of bail. 5. On consideration of the rival submissions, the material available on record, and in view of the submission made by the learned Public Prosecutor that the material witnesses of the prosecution have already been examined and the trial is at the fag end but without expressing any opinion on merits/demerits of the case, this Court is not inclined to extend the benefit of bail to the present petitioner. 6. Hence, the present bail application under Section 483 is dismissed. (PRAMIL KUMAR MATHUR),J 20/RASHMI
