This is the Third bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 25/2023 registered at Police Station-Chilfi, District Kabirdham (C.G.), for the offence punishable under Section 20(b)(ii)(C) of the NDPS Act. 2. Earlier First and Second bail applications of the applicant were rejected by this Court being MCRC No. 8026 of 2024 and MCRC KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 No. 8973 of 2025 respectively, vide order dated 20.11.2024 and 10.11.2025, on merits. Hence, the present bail application. 3. Case of the prosecution, in brief, is that on 29.06.2023, the police authorities of Police Station -Chilfi District- Kabirdham (C.G.) received a secret information from the informant and on the basis of said information the Police has conducted raid and seized 76.610 kg of Ganja from the possession of the applicant. Therefore, the alleged offence has been registered against the present applicants. 4. Learned counsel for the applicant submits that this is the third bail application on behalf of the applicant. The first and second bail applications were rejected on merits by this Court vide orders dated 20.11.2024 and 10.11.2025 passed in MCRC No. 8026 of 2024 and MCRC No. 8973 of 2025, respectively. He further submits that the applicant has been languishing in jail since 07.08.2024 and the matter is now fixed for final arguments, hence no further custodial interrogation is required. The applicant undertakes to abide by all conditions imposed by this Court and there is no likelihood of absconding or tampering with evidence. Accordingly, it is prayed that the applicant be enlarged on bail. 5.
On the other hand, learned State counsel opposes the prayer for grant of bail and submits that the first and second bail applications of the present applicant have already been rejected on merits by this Court vide orders dated 20.11.2024 and 10.11.2025 passed in MCRC No. 8026 of 2024 and MCRC No. 8973 of 2025, respectively. It is further submitted that a huge quantity of 76.610 kgs of ganja has been seized from the possession of the present
3 applicant, which clearly indicates his active involvement in the alleged offence. Hence, it is prayed that the bail application deserves to be rejected. 6. I have heard learned counsel for the parties and perused the case diary. 7. Taking into consideration the facts and circumstances of the case, nature and gravity of the offence, the fact that the first and second bail applications of the applicant have already been rejected on merits by this Court vide orders dated 20.11.2024 and 10.11.2025 passed in MCRC No. 8026 of 2024 and MCRC No. 8973 of 2025, respectively, as well as the period of detention of the applicant since 07.08.2024, and further considering that the present matter is now fixed for final arguments, this Court is of the considered opinion that no case for grant of bail is made out at this stage. 8. Accordingly, the Third bail application of the applicant- Raju Singh Thakur, involved in Crime No. 25/2023 registered at Police Station- Chilfi, District Kabirdham (C.G.), for the offence punishable under Section 20(b)(ii)(C) of the NDPS Act, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. OfÏce is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
