The petitioner has filed this writ petition under Article 226 of the Constitution of India assailing the order dated 28.05.2010 passed by the Collector, District - Raipur (C.G.) in Case No. 158/B-121 of 2020-21 by which the respondent authority deducted the 30% of the award amount and passed the award. Learned counsel for the petitioner would submit that respondent No. 2 and 6 has recommended the petitioner to provide compensation at the rate of Rs. 21,000/- per square meter, but the respondent No. 3 has illegally reduced compensation amount against the acquired land. He would further submit that the direction for providing compensation given by the superior authority, the subordinate authority cannot reduce the same. Thus, he would pray for allowing the petition and quashment of the order dated 28.05.2010. 3. Per contra, learned State counsel would submit that the petitioner has alternate and efficacious remedy to take recourse available to him under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (in short “Act of 2013”). 4. Since the petitioner has alternate and efficacious remedy under the Act of 2013 and disputed facts are involved, the present writ petition is disposed of granting liberty to the petitioner take recourse available to him under the Act of 2013.
