This hearing has been done through hybrid mode. 2. The present petition has been filed by the Petitioners under Article 226 of the Constitution of India, inter alia, challenging the elections of the Town Vending Committee (hereinafter, ‘TVC’) constituted under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, which were held on 02nd August, 2026 and results were declared on 04th August, 2026. The case of the Petitioners is that they were contesting candidates in the TVC elections having Ballot Nos. 5, 8,3,7. However, they were denied the opportunity to verify the ballot paper themselves or have their counting agents verify the same, when the votes were being counted on 4th August, 2026. 4. The submission of Mr. Aditya, ld. Counsel for the Petitioners is that the proper electoral records of the TVC elections are not being preserved, and the elections were not conducted in a free and fair manner. 5. It is the further case of the Petitioners that they have made a representation dated 06th August, 2026 to the Respondents for recounting of votes. However, no effective response has been received from the Respondents till date. 6. Mr. Sachdeva, ld. Counsel for the MCD submits that the elections of the TVC were conducted as per the prescribed scheme and in a fair manner, in terms of paragraph 25 and 59 of the Municipal Corporation of Delhi (Election of the members of Town Vending Committee from amongst the street vendors) Guidelines, 2026, (hereinafter, ‘Guidelines, 2026’). It is also submitted that the electoral records are also being preserved. 7. This Court is of the opinion that the present writ petition challenging elections to the TVC would not be liable to be entertained, and the Petitioners ought to avail of their remedies in accordance with law. 8. After some hearing, ld. Counsel for the Petitioner submits that he does not press the petition, and he would approach the Competent Court by filing an election petition. 9. The same is permitted. Insofar as the representation dated 6th August, 2026 is concerned, the MCD may consider the same in accordance with law. This is a digitally signed order.
