1. The applicant seeks interim bail in case arising out of FIR No.965/2022 dated 27.08.2022, registered at P.S. Nihal Vihar, for commission of offences under Sections 302/307 IPC. 2. The applicant, as per the allegations, had caused death of father-in-law of his daughter and also caused injuries to one her other relative. 3. He was arrested on 27.08.2022. 4. Nominal Roll of the applicant has been requisitioned from the Jail which indicates that his period of incarceration is of more than 3 ½ years and his jail conduct is satisfactory. 5. Mr. Dalal, learned counsel for the applicant submits that on one previous occasion, the applicant had prayed for interim bail as he had to undergo Umbilical Hernia surgery and was granted bail by this Court for a period of four weeks. He refers to order dated 11.12.2024 passed in BAIL APPLN. 4365/2024. He submits that extension was also granted by this Court This is a digitally signed order. and after the expiry of such extended interim bail, he had surrendered. 6. Learned APP for the State submits that out of 21 cited witnesses, prosecution has examined 12 witnesses so far and the matter is getting delayed as FSL report has yet not been received and, therefore, testimony of one of the injured is lying incomplete. Director, FSL is requested to expedite the preparation of the report, which becomes imperative for the reason that period of incarceration of the applicant is already quite high. 7. The next date before the learned Trial Court is stated to be 01.10.2026. 8. The interim bail is being sought in view of applicant’s own deteriorating health. 9.
The medical report of the applicant was sought and the relevant part of such report is as under:-
“As per available records, it is hereby submitted that the inmate patient re-admitted in Tihar CJ-4 on 12/10/2025, wherein his medical examination was done by the duty doctor. In medical examination inmate patient gave history of being a known case of Hypertension/ Type-ll Diabetes Mellitus (on medication), alleged history of hernia surgery (done on 02/02/2025), complaint of on and off bleeding per rectum for last 10-15 days, for which he was prescribed treatment and advised to review in OPD. As per available medical records the inmate patient visited jail dispensary on multiple times in recent past with complaint of pain abdomen post operative case of Hernioplasty, known case of Type-ll Diabetes Mellitus/ Dyslipedemia with complaint of decreased vision, body ache, constipation, sore throat, on and off fever, for which he was examined and prescribed appropriate treatment cach time accordingly. It is further submitted that he has been provided all the medication as prescribed by concerned specialist from time to time from jail dispensary itself apart from ensuring timely investigations and reviews whenever required. On 28/10/2025 patient was reviewed by jail visiting Medicine SR as a follow-up case of Type-ll Diabetes Mellitus/ fatty liver, on examination- random blood sugar was found-233mg/dl, prescribed treatment and advised to review accordingly. Further on 30/10/2025 inmate patient was again presented at jail This is a digitally signed order. dispensary with complaint of vomiting and loose stool. on examination random blood sugar found on higher side (422mg/dl), prescribed treatment accordingly. Thereafter on 12/12/2025 and 23/12/2025 inmate patient visited DDU Hospital for Eye follow-up for his complaint of headache and decreased vision and received treatment advice accordingly.
On 07/11/2025 inmate patient was examined by jail visiting Surgery SR for his persistent complaint of abdominal pain mainly at operative site (umbilical hernia repair in feb-2025) and provided symptomatic treatment.”
10. Undoubtedly, earlier also, the applicant had prayed for interim bail citing his poor health and this Court had declined to release him on interim bail. However, at the same time, he was not precluded to approach the Court again, in case his medical condition worsened or there was any emergent medical requirement. 11. The abovesaid Medical Report dated 07.08.2026 does not portray a rosy picture about his overall medical condition. Though, he is being managed and is being referred to other hospitals, wherever so required, keeping in mind the multiple ailments with which he is suffering, this Court is inclined to released him on interim bail for a period of four weeks so that he can take appropriate treatment, outside the Jail. 12. In view of the above, the applicant is, hereby, granted interim bail for a period of four weeks on the same terms and conditions as mentioned in order dated 11.12.2024 passed by this Court in BAIL APPLN. 4365/2024.
