Sharmita Datta Das, Adv. Keya Sutradhar, …for the State. Affidavit of service filed by the petitioners is taken on record. None appears for the Panchayat despite service. The petitioners allege that the Pradhan, Rajarhat- Bishnur-I Gram Panchayat, being the 3rd respondent herein, is constructing a drain beside the land of the petitioners. Since the drain leads to the private pond of the petitioners, polluted water of the entire village shall fall into the pond which shall render the pond unusable. The petitioners submitted a representation before the 3rd respondent in this regard on 11th February, 2026 which is yet to be considered. Upon consideration of the submission made on behalf of the parties, the 3rd respondent is directed to consider and dispose of the representation submitted by the petitioners dated 11th February, 2026 within two weeks from date upon granting reasonable opportunity of hearing to the petitioners, in accordance with law. 2 The decision taken by the authority shall be communicated to the petitioners within a week thereof. Pending disposal of the representation, no further construction of the drain in question shall continue. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
