2. This application, under Section 483 of the BNSS, 2023, is preferred by the accused, namely, Abdul Monnan, in connection with Sribhumi P.S. Case No.
Page No.# 2/3 165/2026, registered under Sections 303(1)/317(2)/3(5) of the BNS, 2023, read with Section 13(1) of the Assam Cattle Preservation Act, 2021.

It is the case of the petitioner that the informant of this case, namely, Bishal Chetri, an UBC of Police, had lodged an FIR before the Sribhumi P.S., alleging, inter alia, that on 17.07.2026, at about 4:00 PM, the In-charge, Longai Police Outpost, had received secret information that some persons were illegally possessing and supplying cattle and, accordingly, the police had conducted a raid and found four accused persons in possession of 7 (seven) cattle, consisting of 5 (five) bullocks and 2 (two) bovine cows. Subsequently, the informant lodged the FIR, which was registered as Sribhumi P.S. Case No. 165/2026.
4. The co-accused of this case has been granted bail vide order dated 17.08.2026 in Bail Appln. 2211/2026, after 30 days in custody. The present petitioner has already spent 60 days in custody.
5. Under the given facts and circumstances, this Court is of the view that further custodial detention of the accused seems to be unwarranted, herein this case. And accordingly, this Court is inclined to allow this petition.
6. It is provided that on furnishing a bond of Rs. 25,000/- with one surety of the like amount, to the satisfaction of the learned Sessions Judge, Sribhumi, the accused shall be enlarged on bail.
