The petitioners are apprehending their arrest in connection with Tonto P.S. Case No. 08 of 2025, registered for the offence under Sections 103(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, West Singhbhum at Chaibasa. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and proper treatment was not provided, in view of that, the death has occurred of the deceased. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that there is eyewitness to the occurrence and the petitioners are named in the FIR. 5. In the FIR, there is direct allegation of assault against these petitioners, pursuant to that the death has occurred of the deceased. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for anticipatory bail is rejected [ 2026:JHHC:3832] -2- 6. It is made clear that if the petitioners surrender before the learned court by way of filing regular bail application, the learned trial court will decide the same in accordance with law without prejudice to this order.
