FAO No. 19 of 2022
10.04.2026 Present: Mr. Bhupender Pathania, Advocate, for the non- applicant.
Mr. Anil Kapoor, Advocate, vice Mr. Nimish Gupta, Advocate, for applicants/respondents No 2 & 3.
CMP No. 1690 of 2026
No reply is intended to be filed on behalf of the non- applicant.
Heard learned counsel for the parties and perused the pleadings.
From a perusal of the impugned award dated 07.09.2019, it is evident that the present applicants are entitled to 80% of the awarded amount. Till date, no amount has been released in their favour. In view of the aforesaid, and keeping in view the contentions of the applicants, the application is allowed. Let 30% of the amount awarded in favour of the applicants, along with proportionate interest, be released in their favour. The amount be remitted to their bank accounts, details whereof have been given in paragraph 4 of the application, subject to proper verification of their identities.
It is made clear that, in case the appeal preferred by the non-applicant is allowed, then the applicants shall refund the amount so released along with interest accrued thereon.
The application stands disposed of.
