Petitioner has filed this writ petition seeking following reliefs:- ‘a. Issue a writ of mandamus or any other appropriate order or direction, directing the respondents to forthwith release the petitioner’s gratuity as per the Gratuity Act, 1972, along with interest @ 10% per annum (or whatever Hon’ble Court deems it a fit) from the date of resignation till payment. b. Quash and set aside the impugned rejection- ORDER / withholding of Gratuity (Annexuer P-6) as arbitrary and unconstitutional. c. Award costs of the petition to the petitioner; and d. Pass such other and further orders as this Hon’ble Court deems fit and proper in the interest of justice.” 2. The claim of petitioner towards gratuity is on the ground that petitioner was an employee of Railway Department. However, the grievances of employees service disputes against the Railway Department is to be considered by the Central Administrative Tribunal, therefore, in the opinion of this Court the present writ petition is not maintainable. Accordingly, it is dismissed. 3. However, reserving liberty with the petitioner to file appropriate proceedings before appropriate forum.
