The petitioner has preferred this writ petition under Article 226 of the Constitution of India seeking following reliefs :- “1] That, this Hon'ble Court may kindly be pleased to direct Respondent Nos.1 to 6 to take immediate, effective and permanent action against illegal sale and consumption of liquor being carried out by the respondent No. 09 at the premises owned by Respondent No.7 situated at Ward No. 12, Sheetla Ward, Near Tehsil Office, Rajim, Tehsil Rajim, District Gariaband (C.G) and to permanently close and seal the illegal shop and prohibit any further sale or consumption of liquor at the said site. 2] That, this Hon'ble Court may kindly be pleased to grant any other relief, which it deems fit and proper.” 2. Learned counsel for the petitioner would submit that, petitioner is a permanent resident of Ward No. 12, Sheetla Ward, Rajim, District Gariyaband and residing with his family. It is highly populated locality but adjacent to the house of petitioner, the respondent No. 7 has permitted the respondent No. 9 to run Chakhna shop on his land and because of that, there is serious threat to the peaceful life of residents. It is further submitted that, various representations have been made to respondents No. 2 to 6 in this regard but till date, said shop has not been removed. He also submits that, the petitioner is ready to file a fresh representation for redressal of his grievance. Hence, at this stage, he submits that this petition may be disposed of directing the 3 respondent No. 6/Collector Gariyaband to decide his representation within stipulated period. 3. Learned counsel appearing for the State would submit that, if petitioner files a representation, then it will be decided in accordance with law. 4. Heard learned counsel for the parties and perused the material available on record. 5. If said Chakhna shop is situated in a dense populated area, that too, adjacent to the house of the petitioner, then it is surprising that, why appropriate action has not been taken by the responsible officers. 6. Considering the limited prayer made by learned counsel for the petitioner, this petition is disposed of at this stage, directing the petitioner to file a representation before the respondent No. 6/ Collector, Gariyaband for redressal of his grievance as raised in this writ petition along with a copy of this order within a week from today, then the respondent no. 6 is directed to decide the same on its own merit in accordance with law within a period of 15 days from the date of filing of the representation. 7.
