The case of the petitioners was that the flat in question was already owned by a third party; nevertheless, the petitioners allegedly induced Opposite Party Nos. 1 and 2 to purchase the said flat. However, it is evident that the dispute between the parties has since been amicably settled. Petitioner No. 1 has also submitted a statement before the Officer-in- Charge of the concerned police station indicating the withdrawal of his complaint. This Court is of the view that the dispute between the parties is purely civil in nature. A joint compromise, executed between the parties by way of an affidavit, has been filed before this Court. 2 In view of the judgment of the Hon’ble Supreme Court reported at (2012) 10 SCC 303 (Gian Singh v. State of Punjab), this Court is inclined to quash the proceedings in exercise of its inherent powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Accordingly, ACGR No. 3899 of 2021 arising out of Bansdroni Police Station Case No.182 of 2021 dated 03.10.2021 under Sections 120B/420/406/506/504 of the Indian Penal Code, 1860 pending before the Learned Additional Chief Judicial Magistrate at Alipore, South 24 Parganas stands quashed. Let the report filed by the State, along with the compromise filed by Opposite Party No. 2, be kept on record. Accordingly, CRR 1130 of 2026, along with CRAN 1 of 2026, stands disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.)
