Learned counsel for the petitioners submits that there is no other material available against the present petitioners other than the statement of a co-accused which is not admissible in evidence. Learned counsel for the State relies on the case diary and report and submits that there is a criminal antecedent against the present petitioners involving offences under the NDPS Act. Considering the above, the other materials available in the case diary, the criminal antecedent of the petitioners and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. 2 The application for anticipatory bail is, thus, rejected.
