1. Applicant seeks regular bail in case FIR No.76/2026, registered at Police Station Crime Branch for commission of offences under Sections 3(5)/ 61(2)/ 318(4) 319(2)/ 336(3)/ 336(4)/ 340(2)/ 341(2)/ 341(3)/ 341(4)/350(2)/274/275 of Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 63/65 of Copyright Act, 1957. 2. There was a secret information that a factory was being operated at Moti Nagar, Rama Road and several warehouses were being used in Karol This is a digitally signed order. Bagh, New Delhi for packaging counterfeit products of Oppo, Realme and OnePlus. As per information the above said places were being used for manufacturing and storing counterfeit products. The concerned Authorized Representatives of said Companies were joined in the raid and police team, with the help of such Authorized Representatives, conducted raid at one of the factory premises and at three warehouses. 3. One of the alleged warehouse is situated at third floor of House No.5467, Gali No.71, Regarpura, Karol bagh. 4. The police team had reached at the abovesaid premises at the instance of a rickshaw puller Uma Shankar, where the raiding team saw packing of earbuds of OnePlus and Realme. The applicant Gautam Kumar was present there and when he was asked to show documents and licence with respect to the abovesaid products, he could not show any such document. The Authorized Representatives of the abovesaid companies, however, revealed that all such packaging and even the products were counterfeit. 5. The owner of the building could not be contacted at the time of registration of FIR.
Subsequently, however, the police was able to contact him and his statement was recorded. Said Mr. Kausal revealed that the third floor of the abovesaid premises situated at Regarpura had been rented out to the applicant. 6. Fact, however, remains that there is no rent deed or lease deed with respect to the abovesaid lease or tenancy. 7. As per Seizure Memo, several seized boxes were containing counterfeit products also. Admittedly, some such boxes were found empty as well, albeit, boxes were counterfeit/copied ones. 8. There are in all three accused persons, including the applicant herein. One such accused has not been arrested and has been bound down. 9. The applicant was arrested on 08.04.2026. 10. Nominal Roll of the applicant has been requisitioned from the Jail which indicates his age as 37 years and his overall jail conduct is recorded as satisfactory. He does not have any previous involvement. 11. Keeping in mind the overall facts and circumstances of the case, albeit, without expressing any opinion over the merits of the case, applicant is admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class subject to the following conditions:-
(a) Surety would be local. (b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed. (c) Applicant/accused shall not come in contact of any witness, directly or indirectly. (d) The applicant/accused shall not leave NCR of Delhi, without permission of learned Trial Court. (e) The applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational all the time, till the disposal of the case. 12.
The application stands disposed of in aforesaid terms. 13. A copy of this order be sent to the concerned Court and also to the Jail Superintendent for necessary information and compliance.
