It appears from the report furnished before this Court that the de facto complainant expressed her unwilling to proceed further with this proceeding and accordingly she expressed before the learned Magistrate not to proceed the case further. 3. Both the learned advocates are present before this court. 4. In the decision of the Hon’ble Supreme Court in Mathukar & Ors. Vs. State of Maharashtra & Anr reported in 2025 SCC OnLine SC 1415, the Hon’ble Supreme Court was of the view that the complainant expressed her desire not to pursue the case before the learned Magistrate and is not willing to continue the proceeding and hence the settlement arrived at between the parties was considered. 5. In the present case also considering the facts and circumstances and the statement given by the present de facto complainant herself expressing her unwillingness to continue further, this Court is of the view that there is no reason to allow this proceeding further and the possibility of conviction will be bleak. 6. Hence, this revisional application is disposed of and the proceeding pending before the learned Court of Magistrate quashing in view of the above settlement. 7.
