BEFORE HON’BLE MRS. JUSTICE SHAMIMA JAHAN ORDER 15.09.2026 Heard Mr P K Deka, learned counsel for the petitioner and Mr B Sarma, learned Additional Public Prosecutor for the State of Assam.
2. By this application, the petitioner has prayed for pre-arrest bail in connection with Changsari PS Case No. 58/2025, registered under Sections 316(3) of the BNSS, 2023.
3. The First Information Report in connection with which the petitioner is apprehending arrest, was lodged on 10.03.2025 by the Branch Manager of PCC
Page No.# 2/2 Logistics Limited, stating inter alia, that a truck loaded with articles along with documents connected therewith, was sent from Gauripur, but the said truck did not reach the destination. It is also alleged by the informant that the cell phone of the driver was also switched off.
4. The learned counsel for the petitioner submits that the petitioner has no connection, whatsoever that has been narrated in the FIR and that the said truck was driven by the driver, namely, Abdus Mia and was owned by others.
5. Mr B Sarma, however, submits that materials are found showing the complicity of the petitioner with regard to the missing of the said vehicle. However, it is seen that the petitioner was enlarged on interim pre-arrest bail vide order dated 08.06.2026, on the condition that he should make himself available, within a period of 7(seven) days before the Investigating Officer and get his statement recorded. Mr B Sarma, on perusal of the Case Diary, submits that the petitioner has already appeared before the Investigating Officer and that his statement has also been recorded. As such, it is seen that the petitioner is cooperating with the investigation and accordingly, this Court deems it fit to make the order dated 08.06.2026, absolute, with the further condition that he should abide by the directions and the conditions of the bail order dated
08.06.2026.
