JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 3 are before this Court calling in question entire proceedings in C.C.No.62129/2023, pending before the XI Additional Chief Metropolitan Magistrate Court, Bengaluru, for offences punishable under Sections 498A r/w. 34 of the IPC and Section 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners – accused and respondent No.2 – complainant in unison submit that during the pendency of these proceedings, the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions. An application – I.A.No.1/2026 under Section 320 of the Cr.P.C. and a joint affidavit of the parties are filed before this Court seeking permission to compound the offences. 3. The application reads as follows: “1. The above petition has been preferred by the petitioners herein praying this Hon'ble Court be pleased to pass the order quash the entire proceedings of the case in C.C.No.62129/2023 pending file on the Learned - 4 - HC-KAR NC: 2026:KHC:13423 CRL.P No. 1969 of 2026 XI Add Chief Metropolitan Magistrate at Bangalore for the offence punishable under Sections 498/A of IPC and Section 4 of Dowry Prohibition Act. 02. It is submitted that, the respondent No.2 on whose statement the entire case is built up, in view of the advice by the elders and well-wishers is not Inclined to prosecute the above case, accordingly is supporting the case of the prosecution, thereby the chances of conviction of the petitioners are very bleak and no useful purpose is likely to be served by allowing a criminal prosecution to continue. 03. The Respondent No 2 entered to this compromise on her own will and volition. There is no threat or cohesion by anybody. 04. If this Hon'ble Court is not pleased to permit the parties to compound the above case, they will suffer irreparable loss and great hardship. WHEREFORE, the petitioners and the respondent No 2 in the above care pray that, this Hon'ble Court be pleased to permit them to compound the offence punishable under Sections 498/A of IPC & Section 4 of Dowry prohibition act in C.C.No. 62129/2023 pending on the file of the Learned XI Add Chief Metropolitan Magistrate, At Bangalore to secure the ends of justice.” - 5 - HC-KAR NC: 2026:KHC:13423 CRL.P No. 1969 of 2026 In the light of the afore-quoted terms and conditions, I deem it appropriate to terminate the proceedings against the petitioners, as it is a matrimonial dispute and the allegations are not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The proceedings in C.C.No.62129/2023, pending before the XI Additional Chief Metropolitan Magistrate Court, Bengaluru, qua the petitioners, stands quashed.
