In this writ application, the petitioner has prayed for setting aside the Memo dated 08.04.2026, issued by the Circle Officer, Mandu whereby the petitioner has been directed to be evicted from the land situated in Mouza Bongabar, Khata No. 192, Plot No. 198, Area 0.88 acres and Plot No. 200 area 1.88 acre, total area 2.76 acre, in view of the order passed in Land Restoration Appeal No. 28 of 2025. The petitioner has further prayed for a direction upon the respondent no. 2 to pass an order in respect to the prayer of the petitioner regarding stay of the order dated 06.04.2026 passed in Land Restoration Appeal No. 28 of 2025. Submission has been advanced by the learned counsel for the 2 petitioner that a fresh round of litigation has been entered into with respect to an application preferred under Section 71A of the Chotanagpur Tenancy Act which was allowed, against which the petitioner had preferred an appeal being Land Restoration Appeal No. 28 of 2025 and on dismissal of which, revision application has been preferred being Land Restoration Revision No. 13 of 2026. Learned counsel submits that though the stay application has been preferred before the respondent no. 2 but the respondent no. 2 is not acting upon the same and in the meantime the Circle Officer has passed a direction for eviction of the petitioner from the land in question vide Memo dated 08.04.2026. Learned SC (L & C) - I, has submitted that in the earlier round of litigation, the petitioner had lost up to this Court and subsequently on the application preferred under Section 71A of the Chotanagpur Tenancy Act, the petitioner has lost up to the Appellate Court. It appears that a stay application has already been preferred in Land Restoration Revision No. 13 of 2026 before the respondent no. 2 and as submitted by the learned counsel for the petitioner, the same has not been considered and the petitioner apprehends that pursuant to the Memo dated 08.04.2026 issued by the Circle Officer, Mandu, the petitioner will be evicted from the land in question. In view of the fact that the stay application has already been preferred before the respondent no. 2 without entering into the merits of the case, this writ application stands disposed of with a direction to the respondent no. 2 to consider the stay application preferred by the petitioner in Land Restoration Revision No. 13 of 2026 at the earliest and preferably within a period of one week from the date of the receipt / a production of a copy of this order.
