Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 4 months and petitioner and the deceased were admittedly married. Because of certain issues, the wife committed suicide and the petitioner has been charged with a case of murder.
Learned advocate for the State opposes the prayer for bail and submits that charges have already been framed in the instant case and witness action has commenced.
I have taken into account the post-mortem report, the attending circumstances and the fact that the prosecution has relied upon 12 witnesses in order to prove its case. Having
2 considered that some time will be required for the trial to be taken to its logical conclusion, without entering into the merits of the case, I am inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ADJ, 2nd Court, Malda cum Special Judge, POCSO Court. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the Learned Trial Court.
Accordingly, CRM (M) 684 of 2026 is allowed.
