Order on Board 27.04.2026 1 By filing the present petition, the petitioner is not assailing any specific order passed by the authorities. 2 which is Government land, in favour of a prospective purchaser. The petitioner has prayed for following reliefs :-
“10.1 That the Hon'ble Court may kindly be pleased to direct the respondent no. 2 to decide the pending application of the petitioner dated 09.03.2026 moved under Section 165(6) (a) & 165(6)(b) & (c) of Chhattisgarh Land Revenue Code, 1959 for permission to sale her land. 10.2 That the Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.3 Any other relief, which may deem fit, in the interest of justice.” 2
Learned counsel for the petitioner submits that the petitioner, Kiran Manikpuri, is the recorded pattadar of Government land bearing Khasra No. 161, admeasuring 0.6100 hectare, situated at Village Jevra, District Bemetara (C.G.), and has been in peaceful possession and enjoyment of the said land for more than 21 years. It is submitted that the said land is the only source of livelihood of the petitioner’s family. It is further submitted that the petitioner has a large family consisting of her children, including a married daughter, two unmarried sons, and the widow and minor children of her deceased son Yogesh Manikpuri, who died due to serious ailments. It is contended that substantial expenses were incurred in the treatment of the deceased son, for which the petitioner had to borrow money from relatives, and presently she
3 is under financial distress with mounting liabilities and no other source of income except the said agricultural land. 3
Learned counsel submits that in these compelling circumstances, the petitioner intends to sell the said land for repayment of debts and for the sustenance of the family members, and accordingly, an application dated 09.03.2026 has been submitted before respondent No. 2 seeking permission under Section 165(6)(a), 165(6)(b) and 165(6)(c) of the Chhattisgarh Land Revenue Code,
1959. However, the said application is still pending consideration, despite earlier direction of this Court in WPC No. 1592/2024 to decide the same within a stipulated time. It is thus prayed that respondent No. 2 be directed to decide the pending application expeditiously in accordance with law. 4 On the other hand, learned State counsel submits that the application filed by the petitioner is purely administrative in nature and requires consideration by the competent authority in accordance with law. It is submitted that the same shall be decided expeditiously, preferably within a short and stipulated period, without causing any unnecessary delay. 5 I have heard learned counsel for the parties and perused the record. 6 Considering the matter in its entirety, it is observed that the petitioner has approached this Court seeking a direction for expeditious consideration of his pending application for grant of
4 permission under Section 165(6)(a), 165(6)(b) and 165(6)(c) of the Chhattisgarh Land Revenue Code, 1959. It is stated that the said application is pending before the competent authority without any final decision, thereby causing hardship to the petitioner. 7 In view of the limited grievance raised and without entering into the merits of the claim, it is deemed appropriate to dispose of the present writ petition with a direction to the concerned authority to consider and decide the petitioner’s application strictly in accordance with law. The petitioner shall be afforded due and proper opportunity of hearing, and all relevant documents and
submissions placed by the petitioner shall be taken into
consideration before passing a reasoned and speaking order. 8 Accordingly, the Collector, Bemetara, District Bemetara (C.G.) is
directed to decide the petitioner’s application expeditiously and preferably within a period of 60 days from the date of receipt of a certified copy of this order. It is further directed that the entire exercise shall be carried out in a fair and transparent manner, in accordance with the provisions of law. 9 With the aforesaid observations and directions, the instant writ petition stands disposed of. 10 There shall be no order as to costs.
