Learned advocate appearing for the petitioner submits that petitioner is in custody for 286 days and the subject- matter of recovery in the present case is 90 kgs. of ganja. Petitioner is a Helper of a Truck and is innocent of the charges. As such, petitioner may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that other accused persons are absconding. Having regard to the quantum of seizure, I am of the view that the rigors of Section 37 of the NDPS Act are attracted. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 303 of 2026, is, thus, dismissed. 2 All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
