The Court made the following Order:
Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for the respondent Nos.1 to 4 and the learned counsel appearing for the respondent Nos.6 to 8. 2. This writ petition was filed questioning the letter addressed by the 4th respondent to the 3rd respondent dated 15.09.2023. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 13.01.2026 submits that the RDO-cum-Settlement Officer sent a letter to the 4th respondent to conduct an enquiry through case No. L/276/2001 dated 09.10.2003. The said case was sent back and case No.6107 was taken. In case No.6107, Bellamkonda Veeraiah died without children, so their share of the land was devolved upon his younger brother Bellamkonda Chandraiah as per the Hindu Succession Act, and as Bellamkonda Papa Rao was the only son of Bellamkonda Chandraiah, the entire patta was registered in the name of Bellamkonda Papa Rao under Sy.No.61/3 Yakaram to an extent of Ac.1.20 cents and Sy.No.61/5 to an extent of Ac.4.02 cents patta was granted on dated 01.03.2004 in the name of Bellamkonda Papa Rao. 4. When the order was examined, it was found that, the joint patta was issued on 01.03.2004.
However, Bellamkonda Veeraiah did not die without a son. He had a son by name Bellamkonda Kotaiah. Similarly,
5
Bellamkonda Chandrayya also had children named Bellamkonda Balaswamy and Bellamkonda Lakshmi @ Putti Lakshmi. It is not true that only the person by name Bellamkonda Paparao is the only son. Bellamkonda Papa Rao obtained the title in this manner for the entire extent of Ac.1.30 cents in Sy.No.61/2 and Ac.1.20 cents in Sy.No.61/3 came to the share of Bellamkonda Veeraiah which is cultivated by his son Bellamkonda Kotaiah. Thus, Bellamkonda Chandraiah share became Ac.4.02 cents. The heirs of Chandraiah namely Bellamkonda Balaswamy, Papa Rao and Putti Lakshmi are cultivating the said land equally. However, due to many disputes between them, it has come to light that Bellamkonda Papa Rao is denying the share to Putti Lakshmi. It has further revealed that even though the title of Bellamkonda Kotaiah is in the name of Papa Rao, they are not causing any trouble at the farm. 5. Cr.No.72/2022 and 73/2022 have been registered by Yetapaka PS bearing FIR No.73/2022 against Bellamkonda Paparao for fraudulently obtaining the land title. Since the complaint was filed by the 6th respondent i.e., Smt. Putty Lakshmi W/o Srinivasa Rao before the 3rd respondent and as per the instructions of the 3rd respondent dated 02.07.2022 and enquiry report was submitted by the 4th respondent vide letter dated 15.09.2023 which is impugned in this writ petition. 6
6. In view of the above said facts and circumstances, as the impugned letter of the 4th respondent addressed to the 3rd respondent dated 15.09.2023 does not disclose any termination of the rights of the parties concerned and as there is no adverse order passed against either of the parties concerned specifically the petitioner and the respondent Nos.6 to 8 and as it is only a submission of report to the 3rd respondent, it cannot be assailed in this writ petition and as such as there is no progress in the matter further pursuant to the above said impugned letter, no further orders are necessary in this writ petition and it is a premature lis without any cause of action.
However, liberty is given to the petitioner and the unofficial respondents to assail the proceedings if there is any cause of action and if there is any procedings from the authorities concerned affecting adversely their interest/ rights over the subject lands. 7. Accordingly, the writ petition is dismissed. The written instructions of the 4th respondent dated 13.01.2026 shall be made as part of the court record. Interim order, if any, deemed to have been vacated. There shall be no order as to costs. As a sequel, Miscellaneous Petitions pending, if any, shall stand closed. _________________________ JUSTICE B KRISHNA MOHAN 11.03.2026 NNN
