Bail petition filed on behalf of the petitioner-Dhiraj Kumar Pandey @ Dhiraj Pandey, who is in custody since 28.07.2025 in connection with Pratappur P.S. Case No. 70 of 2025 for the offence registered under Sections 103(1), 3(5) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Sub Divisional Judicial Magistrate, Chatra, is pressed into motion.
Deceased died a suicidal death by hanging in her matrimonial home within three months after the marriage. It was initially alleged in the FIR, that the death was homicidal in nature in reference to dowry demand. Police on investigation, found that the deceased committed suicide and the charge-sheet has been submitted under Section 108 of the BNSS.
It is submitted by the learned counsel on behalf of the petitioner that the deceased since the inception of marriage was not happy with the marital relationship and she had love-affair with someone else. This has been substantiated during investigation in the statements of the independent witnesses in para-75 and 76 of the Case Diary. No overt-act has been attributed on the part of this petitioner to drive the deceased to commit suicide.
Learned A.P.P. assisted by the counsel on behalf of the informant have vehemently opposed the bail petition. It is submitted that in the FIR itself there is reference of dowry demand and assault to the deceased.
Having considered the submissions advanced, death appears to be suicidal in nature. Allegation of dowry demand is not supported during investigation. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
