Keshri, A.P.P. ----- Oral Order 03 / Dated : 20.02.2026 Heard learned counsel for the parties. The petitioner named above has been made accused in connection with Gidhour P.S. Case No. 37 of 2025 (POCSO Case No. 87 of 2025) for the offence registered under Sections 137(2), 96 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 4 of the POCSO Act, pending in the court of Addl. Sessions Judge-cum-Special Judge, POCSO, Chatra. It is submitted by learned counsel for the petitioner that there is no allegation of sexual assault and there is no material against the petitioner to show that he had enticed away or induced the victim girl. It is also submitted that there was love affair between the petitioner and the victim girl as apparent from the statement of the victim girl. Learned counsel for the State has opposed the prayer for bail. Having considered the submissions advanced, it appears that the statement of the victim girl was recorded under Section 183 of BNSS, 2023 in which she has not supported the prosecution case. Under the circumstance, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
