THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE C.M. POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging wilful disobedience of the order dated 19.03.2025 passed by the learned Single Judge in WP.No.12382/2024 (GM-RES). The learned Single Judge allowed the petition preferred by the complainant. The dispositive part of the said order reads as under: - 3 - HC-KAR NC: 2026:KHC:22495-DB CCC No. 1163 of 2025 "ORDER a. The writ petition is allowed. b. The impugned endorsement dated 16.03.2024 stands quashed. c. Mandamus issues to respondent No.1 to consider the representation dated 16.01.2024 submitted by the petitioner. d. The petitioner shall pay `1/- crore within two weeks from the date of receipt of a copy of the order and the State while considering the representation of the petitioner in terms of Rule 27 of the Rules supra, shall bear in mind that `1/- crore is already paid towards the instalment and appropriate orders be passed within 4 weeks from the date of receipt of the copy of this Order. Ordered accordingly." 2. As is apparent from the above, the learned Single Judge had directed the accused to consider the representation made by the complainant and also directed the complainant to pay a sum of `1,00,00,000/- (Rupees One Crore Only) within 2 weeks from the receipt of the order and the respondent would consider the same as an amount paid towards an installment while considering the complainant's representation under Rule 27 of the Karnataka Land Grant Rules, 1966. It is the complainant's grievance that despite making efforts, the accused is not accepting the sum of `1,00,00,000/- which was directed to be paid by the learned Single - 4 - HC-KAR NC: 2026:KHC:22495-DB CCC No. 1163 of 2025 Judge. The learned counsel also submits that the complainant is now ready and willing to pay the entire amount in one go. However, the accused is not accepting the same. 3. The learned counsel appearing for the accused submits that an appeal has been preferred against the said order, W.A.(FR). No.1167/2026, which is pending. 4. We do not consider it apposite to initiate any proceedings for disobedience of the orders passed by the learned Single Judge. However, we record that the complainant has tendered the amount of `1,00,00,000/- and the consequences in law of making such tender shall follow.
