The present writ petition has been filed seeking a direction to the respondent-MCD to take action on the complaint of the petitioner dated 9th February, 2026. 2. It is stated that the petitioner is a senior citizen and a cancer and heart patient. The grievance of the petitioner is with regard to the construction being carried out by the private respondent no.4 without following the due protocol and safety measures in the property adjacent to his property bearing no. 108, Uday Park, South Extension II, New Delhi 110049 (‘subject property’). 3. Ms. Brar submits that if the petitioner has any further grievance with regard to pollution being caused by the ongoing construction, the remedy of the petitioner would be to approach the National Green Tribunal (‘NGT’). 5. In view thereof, the present writ petition stands disposed of. 6. In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law. 7. All rights, contentions and legal remedies of the owner/occupier shall remain protected. 8. Pending applications stand disposed of.
