HIGH COURT OF JUDICATURE AT ALLAHABAD SPECIAL APPEAL DEFECTIVE No. - 725 of 2026 Court No. - 39 HON'BLE SAUMITRA DAYAL SINGH, J.
HON'BLE SWARUPAMA CHATURVEDI, J. Ref.: Civil Misc. Exemption Application No.01 of 2026
1. The present exemption application is allowed. 2. Exemption prayed for, is granted. Ref.: Civil Misc. Delay Condonation Application No.02 of 2026
3. Present appeal has been filed with a delay of 3 days. 4. Cause shown is sufficient. Delay in filing the present appeal is condoned. Delay condonation application is allowed. Ref.: Appeal
5. Heard Sri Krishna Dwivedi, learned counsel for the original petitioners- appellants, Sri Arimardan Singh Rajpoot, learned Additional Chief Standing Counsel for the State-respondents, Sri Siddharth Singhal, learned counsel for the Commission and perused the record. 6. On merits, we find no good ground to interfere with the orders of the learned single judge dated 19.08.2026 in Avadhesh Kumar Pal and 18 others vs. State of U.P. and 2 others, 2026:AHC:174580. 7. Undeniably, the written exam was conducted in January, 2025. Model answer key was published on 03.07.2025. Objections were invited. All Versus Counsel for Appellant(s) : Bharti Dwivedi, Krishna Dwivedi, Rajendra Kumar Pandey, Virat Counsel for Respondent(s) : C.S.C., Siddharth Singhal Avadhesh Kumar Pal And 3 Others .....Appellant(s) State Of Up And 2 Others .....Respondent(s)
objections, including those filed by the petitioner, were disposed of, and the final answer key was published on 30.08.2025. Thereafter, the result of the written exam was published on 08.10.2025. The writ petition was first filed on 31.07.2026, i.e., almost one year after the publication of the final answer key and 10 months after the declaration of the result of the written examination. 8. In view of those facts, the learned single judge has rightly described that the writ petition had been filed belatedly. The cause of action, if any, had clearly arisen to the petitioner on the declaration of the final answer key wherein his objection to the model answer key had been rejected. The petitioner did not raise any challenge at the relevant time. He participated in the further typing test. Only five months after declaration of the typing test result, the writ petition was first filed. Clearly, the writ petition was hit by laches. The learned single judge, according to us, has rightly dismissed the same as delayed. 9.
In similar circumstances, we have already dealt with the issue and dismissed Abhinay Awasthi vs. State of U.P. and 2 others, 2026:AHC:180224-DB. 10. In view of the above, we find no merit in the present appeal. Accordingly, it stands dismissed. No order as to costs. October 6, 2026 Anurag/- SPLAD No. 725 of 2026 2 (Swarupama Chaturvedi,J.)
