At this stage learned counsel for the applicant submits, applicant did not conceal the fact that he is not having any other criminal history but as at the time of filing the instant bail application he was not having details of the same, therefore, he could not disclose his criminal history in the instant bail application and specific averment in this regard has been made in paragraph 31 of the affidavit filed in support of the instant bail application. 5. Considering the submission made by the rival parties, it reflects that applicant willfully concealed his criminal history and in paragraph 31, he only made following averments: Versus Counsel for Applicant(s) : Kaushal Kishor Pandey, Yogesh Kumar Singh Counsel for Opposite Party(s) : G.A. Sachin Khedi .....Applicant(s) State of U.P. .....Opposite Party(s)
"...31. That, the applicant has a criminal history, which shall be fully explained and brought on record by filing a supplementary affidavit at a later stage/prior to the final hearing of the present bail application."
6. The law is settled that a person who has not come with the clean hands should not get any benefit from the court. 7. Considering the fact that applicant tried to conceal his long criminal history, having number of cases of murder and attempt to murder, in the considered view of this Court, applicant does not deserve any indulgence of this court. 8. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is rejected. 9.
It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial. October 6, 2026 S.A.
