JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.71439/2024, pending on the file of 11th ACJM, Bengaluru, for the offences under Sections 323, 498(A), 504, 506 read with Section 34 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Vinaya Kumar N.D., learned counsel appearing for the petitioners, Sri.Channappa Erappa, learned HCGP appearing for respondent No.1, Sri.K.Akram Pasha, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the subsistence of the proceedings, the parties to the lis and have settled the dispute amongst themselves and have filed a Memorandum of Settlement before this Court. One of the term of the settlement is, closure of the present proceedings. The said Memorandum of Settlement reads as follows: - 4 - HC-KAR NC: 2026:KHC:14460 CRL.P No. 14499 of 2024 "MEMORANDUM OF SETTLEMENT I. The above petition is filed challenging the order taking cognizance of the following offences on report filed by police. The first informant- the 2nd Respondent filed it for offences punishable under section 323, 498A, 504, 506 R/w Section 34 of IPC and Section 3 & 4 of D.P.Act in C.C. No.71439/2024 before the Hon'ble 11th ACJM, Bengaluru City. II. The Petitioners are the nearest relatives of the husband namely Mr.Nayana.D.B who is an accused in a case filed by 2nd Respondent herein for the offences punishable under sections 323, 498A, 504, 506 R/w section 34 of IPC and so also for the offences punishable under section 3 & 4 of D.P.Act. The present petition has been preferred by those relatives of husband seeking quashment of proceedings in C.C.No.71439/2024 pending on the file of 11th ACJM, Bengaluru City. Husband is not a party in this petition filed under section 482 of CrPC. During the course of mediation husband aforementioned of 1st informant also did participate with the consent of all the parties involved in the matter in the presence of the respective advocates. The Parties have decided to amicably settle their matter with the able assistance of the mediator and learned advocates. As the husband aforementioned is not a party to this matter, learned advocates appearing for the parties undertook to request the Hon'ble Court for inclusion of the said husband to the present case as a petitioner. Subject to the orders which may be passed by the Hon'ble court in respect of intended inclusion of the said husband, following agreement will take effect so far as it relates to said husband Mr. Nayana.D.B. So far as other parties are concerned following agreement came to be entered into by them. III. During the course of mediation, the Petitioner No.1 and proposed Petitioner/husband Mr.Nayana.D.B and 2nd Respondent along with their respective counsel were present and identified each other. Both the parties after a thorough discussion with the able assistance of their respective Advocates have resolved their disputes and have agreed to the following terms and conditions :- - 5 - HC-KAR NC: 2026:KHC:14460 CRL.P No. 14499 of 2024 1. The Proposed Petitioner/husband and the 2nd Respondent have agreed to file a petition for decree of divorce by mutual consent before the Family Court, Bengaluru. 2. In view of this settlement the Proposed Petitioner/husband has agreed to pay a sum of Rs.6,00,000/- (Rupees Six Lakhs Only) to the 2ND Respondent towards the maintenance/permanent alimony as full and final settlement of all her claims. The said amount will be paid by the Proposed Petitioner in the following manner: a) The Proposed Petitioner/husband has agreed to pay a sum of Rs.1,00,000/- (Rupees One Lakh Only) to the 2nd Respondent before this Hon'ble Court at the time of reporting this settlement on 13.02.2026. b) The balance amount of Rs.5,00,000/- (Rupees Five Lakhs Only) will be paid by the Proposed Petitioner/husband to the 2nd Respondent at the time of reporting settlement in mutual consent petition before the Family Court, Bengaluru. The 2nd Respondent has agreed for the same. 3. The Proposed Petitioner/husband and the 2nd Respondent have agreed to exchange their valuable articles and other personal belongings at the time of reporting settlement in mutual consent petition before the Family Court, Bengaluru. 4. Both the parties state that they have no claims over the movables or immovable properties belonging to each other either existing or to be acquired in future by them. 5. Both the parties state that they have no other claim/s of any nature as against each other either past, present or future except as detailed above. 6. In view of this settlement the 2nd Respondent has agreed to withdraw Crl. Misc No.76/2025 filed against the Proposed Petitioner and others pending on the file of V-MMTC, Bengaluru. 7. The parties further state that there has been no collusion or force, fraud or any undue influence by any of - 6 - HC-KAR NC: 2026:KHC:14460 CRL.P No. 14499 of 2024 the parties to enter into this compromise in the aforesaid manner. 8. Both the parties admit that they shall not interfere in the lives of each other in future. IV. In view of the aforesaid agreement, both the parties pray that this Hon'ble court may be pleased to record settlement and dispose off the Petition in terms of this agreement…" 4. The parties to the lis are present before this Court and are identified by their respective counsels. The petitioners hands over a demand draft of Rs.1,00,000/- to respondent No.2 and undertakes that another Rs.5,00,000/- will be paid in divorce proceedings. 5. Therefore, in light of the settlement arrived at between the parties quoted supra and the offences not being against the State, I deem it appropriate to terminate the proceedings pending against these petitioners in the subject petition. 6.
