Applicant seeks interim bail for a period of six weeks for the reason that his wife is in family way and the expected date of delivery is 29.09.2026. 2. Applicant is facing trial in case FIR No.1683/2015 dated 25.08.2015 registered at P.S. Mangol Puri for commission of offences under Sections 302/120B/34 of IPC. He was arrested on 28.08.2015 and as per the affidavit placed on record, his incarceration period is already beyond 10 years. 3. Sh. The Order is downloaded from the DHC Server on 22/08/2026 at 10:03:53 BAIL APPLN. 2553/2026 2 though, the allegations appearing in FIR are serious in nature and according to the case of prosecution, a scuffle took place inside jail van in which two under-trials/inmates received injuries and when they were brought to hospital, they were declared brought dead. The applicant herein is one of the alleged assailants responsible for the abovesaid murders. There are in all six accused persons, who are facing the trial. 4. There are 69 cited prosecution witnesses and as per affidavit placed on record, 31 witnesses have been examined so far and, therefore, there is no likelihood of trial getting completed in near future. 5. Sh. Tiwari, learned Senior Counsel for the applicant submits that, on earlier three occasions, the applicant had been granted interim bail and he never misused any such liberty. 6. The medical documents have already been verified, as would be evident from order dated 27.06.2026 passed by learned Trial Court, whereby it had declined to release him on bail. As per verification report, the wife of the applicant is pregnant and has been advised bed rest and the expected date of delivery, as already noted above, is 29.09.2026. Fact remains that learned Sessions Court had declined the request of the applicant, primarily, for the reason that merely because the wife of the applicant is pregnant, he cannot seek interim bail when there are other family members, who can take appropriate care. 7. Learned Addl. P.P. for the State submits that if the applicant is granted bail, there is every chance of his fleeing away as one co-accused has also misused such liberty granted to him. 8. The next date of hearing before the learned Trial Court is stated to be 09.09.2026. This is a digitally signed order. Keeping in mind the overall facts of the case and particularly on humanitarian ground as the wife of the applicant is in family way and without expressing any opinion over the merits of the case, the applicant is, hereby, directed to be released on interim bail for a period of six period on his furnishing personal bond in a sum of Rs.25,000/- with one surety of like amount, subject to satisfaction of learned Trial Court/CMM/Duty Magistrate with the following conditions:- a) Surety would be local. b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed. c) Applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational all the time, till the disposal of the case. d) Applicant shall not leave NCT of Delhi without prior permission of learned Trial Court. e) Applicant shall not try to contact any of the prosecution witnesses. 10. The period of interim bail would be reckoned from the date of release of the applicant and he would surrender before the Jail Authorities immediately after expiry of such period of interim bail. 11. The application stands disposed of in aforesaid terms. 12. A copy of this order be sent to the learned Trial Court and also to the Jail Superintendent for necessary information and compliance.
